Sec. 9-66. Penalties for violation of California Code and Chapter.
Violation of any provision of this Chapter, including any adopted California Code or City amendment thereto, by any person shall constitute a misdemeanor and upon conviction thereof, shall be punishable by a fine as set forth in Monterey City Code Section 1-7. In addition, any such violation may be enforced by the provisions set forth in the City’s Administrative Remedies Ordinance (MCC Sections 1-9 through 1-10.20). In addition to criminal and administrative remedies, each and every such violation shall also constitute a public nuisance, and as such may be enforced by abatement and injunction, or by other civil action where appropriate. Each separate day, or any portion thereof, during which a violation of this Chapter occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided. The issuance or granting of a permit or approval of plans and specifications shall not be deemed of construed to be a permit for, or approval of, any violation of any provisions of any portion of this Chapter.
